Are Magic Mushrooms Legal?

Magic mushrooms grow naturally around the world, but the compound inside them, psilocybin, is illegal. 

In the United States, buying magic mushrooms online is not a good idea. Law enforcement can track packages of psilocybin mushrooms being mailed. Getting caught bringing mushrooms from decriminalized cities to other regions can get folks in serious trouble. Penalties can include fines and jail time, depending on the amount of mushrooms.

Other countries, like Canada and parts of Europe, are more lenient than the United States despite mushrooms being illegal. Some packages might be intercepted, and law enforcement is within their rights to prosecute, but this seems rare. 

Nonetheless, an abundance of shroom shops are opening. Some exist online and others in person, giving the false sense there is an open market for mushrooms —  but even in decriminalized areas of North America, these are all grey and black market operations. 

The exception is in parts of the world where mushrooms have never been made illegal or decriminalized. States like Oregon and Colorado are experimenting with legal access to mushrooms, but currently, personal use or buying from a dispensary is not an option. In these states, psilocybin mushrooms can only be taken with licensed facilitators.

Other countries, like Jamaica or the Netherlands, have legal loopholes allowing mushroom use and purchase.

Amanita Muscaria: The Legal Magic Mushroom

Amanita muscaria is the world's most iconic mushroom. Known as fly agaric, this mushroom has long held a particular spot in folk culture.

The red cap with white spots is the quintessential mushroom. Amanita changes the size of Super Mario on Super Nintendo and is a symbol found in the strangely psychedelic book and movie Alice in Wonderland. There are even theories that the red and white costume of Santa Claus was inspired by the outfits of Siberian shamans known to use fly agaric for divination and healing.

For a long time, it has been assumed that Amanita is poisonous. There are different types of Amanita, and some do have excess amounts of a substance called ibotenic acid, which is toxic. Taking too much can be dangerous, and some have had to go to the hospital for eating the wrong mushroom, but there has not been a reported Amanita death for 100 years.

The trick to safely consuming Amanita is preparing it properly. When dried thoroughly, much of the ibotenic acid turns into muscimol, and further boiling in acidic water for hours converts more into muscimol.

Muscimol works in several ways in the body. As a cholinergic, it interacts with the acetylcholine receptors in the body, which are connected to the parasympathetic system — the part of the nervous system responsible for calming us down — which leads to sedating effects. Muscimol also has a structure similar to GABA, a neurotransmitter known as the "breaks pedals of the brain" and known to have mellowing and antianxiety effects. These may explain some of Amanita’s effects, but in truth, scientists don't know precisely how the psychedelic effects of Amanita come about and are still learning.

What’s the Best Dose for Amanita Mushrooms?

The best dose of Amanita will be different for everyone. Previously, dosing Amanita meant how big or how many mushrooms you ate. 

For an average psychoactive dose, about three average-sized caps are thought to do the trick. Dosing with whole mushrooms can be challenging because of the variable amounts of muscimol. 

Extracts and modern science make dosing much easier. Research tells us that a psychoactive dose is about 8 to 15 mg of muscimol, but everyone responds a bit differently. Start by taking half a gummy and wait at least 60 minutes for the effects. It's important to wait a long time between doses, as it can take over three hours for Amanita to take effect in some cases.

Psilocybin is an unmistakable state of mind where events take on deep meaning, and emotions become amplified. Music and art can take on new qualities, and hallucinations like melting surfaces or colorful geometry can appear. Both deep acceptance and overwhelming anxiety can be part of psilocybin mushrooms, sometimes all at the same time.

Some might call Amanita muscaria psychedelic, but we prefer the term psychoactive. Perceptions do become altered, but it’s a bit like a dream. Humans like the same trees as Amanita and have brought them around the world with them, planting them in Africa, Australia, and South America. Because Amanita spores and mycelium were in the roots of some of these trees, it now grows far beyond its natural range.

Because of this special relationship to trees, many mushroom hunters will look for specific species of trees when foraging. The relationship also makes it difficult to cultivate Amanita in artificial environments. Most of the muscimol in these gummies comes from wild-harvested Amanita and is then extracted.
